1. Introduction:

1.1 HALALICIOUS Pty Ltd (“we”, “us”, “our”) is committed to protecting the privacy of vendors and their staff in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

1.2 This Privacy Policy explains how we collect, use, and safeguard information about Vendors when they use the Vendor Platform.

 

2. Information We Collect We may collect the following Vendor information:

2.1 Business Information: Business name, ABN/ACN, business address, menu details, pricing.

2.2 Account Information: Owner/manager name, email address, phone number.

2.3 Staff Information: Names and contact details of staff or managers assigned by the Vendor.

2.4 Financial Information: Membership payment details, bank account or PayPal details for settlements.

2.5 Operational Data: Order history, booking records, transaction logs.

 

3. Use of Information We use Vendor information to:

3.1 Provide and operate the Vendor Platform;

3.2 Process membership subscriptions and payments;

3.3 Facilitate communication between Vendors and Users;

3.4 Verify halal compliance;

3.5 Monitor and improve our services;

3.6 Comply with legal obligations.

 

4. Disclosure of Information

4.1 We may disclose Vendor information to:

a) Users, to facilitate orders and bookings;

b) Service providers (e.g., PayPal for payments, Mapbox for location services);

c) Legal or regulatory authorities, where required by law.

4.2 We do not sell Vendor information to third parties.

 

5. Data Security

5.1 We take reasonable administrative, technical, and organisational measures to protect Vendor data.

5.2 Vendors acknowledge that no system is completely secure, and data transmission is at their own risk.

 

6. Data Retention

6.1 We retain Vendor information as long as necessary to provide services, maintain financial records, and comply with legal obligations.

6.2 Vendors may request deletion of their data, subject to outstanding legal or contractual obligations.

 

7. Vendor Rights Under the Privacy Act 1988 (Cth), Vendors may:

7.1 Request access to the information we hold;

7.2 Request corrections of inaccurate or outdated information;

7.3 Request account deletion (subject to membership obligations).

 

8. Changes to this Policy

8.1 We may update this Privacy Policy periodically.

8.2 Continued use of the Vendor Platform constitutes acceptance of the revised policy.

1. Introduction

Welcome to Halalicious. These User Terms & Conditions ("Terms") govern your access to and use of the Halalicious platform, including:

• The Halalicious mobile application;

• The Halalicious website (halalicious.com.au);

• Online food ordering services;

• Restaurant discovery services;

• Dine-in and takeaway ordering facilities;

• Promotional offers, vouchers, and related services. The mobile application, website, and all related services are collectively referred to as the "Platform".

By accessing, browsing, creating an account, placing an order, making a payment, or using any feature of the Platform, you agree to be legally bound by these Terms. If you do not agree with these Terms, you must not use the Platform.

 

2. About Halalicious

Halalicious is an online halal food marketplace that connects customers with participating restaurants across Australia.

The Platform allows customers to:

• Discover halal restaurants;

• View restaurant menus, prices, locations, and business information;

• Place takeaway and online food orders;

• Request dine-in bookings where available;

• Make secure online payments;

• Access restaurant offers and promotions;

• Provide ratings and reviews.

Halalicious provides the technology platform that allows customers and restaurants to connect and complete transactions. Halalicious does not prepare, manufacture, sell, or supply food. Restaurants listed on the Platform operate independently and are responsible for preparing and fulfilling customer orders.

 

3. Eligibility and Account Registration

To use the Platform, you must:

• Be at least 18 years old, or have permission from a parent or legal guardian;

• Provide accurate and complete account information;

• Maintain the security and confidentiality of your login details.

You are responsible for all activities conducted through your account. You must notify Halalicious immediately if you suspect unauthorised access to your account.

 

4. Restaurant Listings and Information

Halalicious works with independent restaurants and businesses that provide information displayed on the Platform.

Restaurant information may include:

• Business name;

• Menu items;

• Prices;

• Opening hours;

• Location details;

• Images;

• Promotions;

• Halal-related information.

While Halalicious aims to provide accurate information, restaurants are responsible for ensuring their information is current and correct.

Halalicious does not guarantee that restaurant information, menu availability, pricing, or operating hours will always be accurate.

 

5. Halal Food Information

Halalicious provides a platform for users to discover restaurants offering halal food or halal options.

Halalicious does not independently certify, inspect, or guarantee the halal status of any restaurant or food product. Customers with specific dietary, religious, allergy, or ingredient requirements should confirm details directly with the restaurant before ordering. Restaurants are solely responsible for their food ingredients, preparation methods, certifications, and halal claims.

 

6. Orders and Payments

Customers may place orders through the Halalicious website or mobile application.

When placing an order:

• Customers must provide accurate order and contact details;

• Customers must review their order before confirming payment;

• Customers authorise Halalicious to process payment for the order;

• Orders are subject to restaurant acceptance and availability.

Halalicious may collect the full payment amount from customers on behalf of participating restaurants.

Payments may be processed through third-party payment providers, including but not limited to:

• Stripe;

• PayPal;

• Other authorised payment service providers.

Once payment has been successfully processed, Halalicious will transmit the order details to the selected restaurant. Restaurants receive payment settlements from Halalicious according to their applicable Restaurant Partner Agreement, after deduction of any agreed commissions, service fees, payment processing fees, or other applicable charges.

 

7. Restaurant Partnerships and Business Models

Restaurants participating on Halalicious may operate under different commercial arrangements, including:

• Commission-based partnerships;

• Subscription-based partnerships;

• Promotional marketing arrangements;

• Other agreed commercial models.

The commercial relationship between Halalicious and restaurants does not change the customer's obligation to pay the amount displayed during checkout. Any commission, subscription fees, or other commercial arrangements between Halalicious and restaurants are separate from the customer's transaction.

 

8. Order Fulfilment

Restaurants are responsible for:

• Accepting and preparing orders;

• Food quality;

• Food safety;

• Packaging;

• Order accuracy;

• Providing the ordered food to customers;

• Managing allergens and dietary requirements.

Halalicious facilitates communication and transactions between customers and restaurants but is not responsible for the preparation or quality of food supplied by restaurants.

 

9. Pickup, Takeaway and Dine-In

Orders For takeaway orders:

• Customers must collect orders from the selected restaurant unless delivery is specifically offered;

• Customers are responsible for collecting orders at the agreed time;

• Restaurants are responsible for preparing the order. For dine-in bookings or orders:

• Restaurant availability is controlled by the restaurant;

• Customers must comply with restaurant booking conditions;

• Restaurants may apply their own policies regarding seating, availability, and cancellations.

 

10. Refunds and Cancellations

Refunds and cancellations are handled according to the Halalicious Refund Policy and Cancellation Policy. Customers may request cancellation or refund where applicable.

Refund decisions may depend on:

• Whether the restaurant has accepted the order;

• Whether food preparation has commenced;

• Whether the order has been fulfilled;

• The reason for the request.

Where a refund is approved, Halalicious may apply applicable service fees or administrative charges as outlined in the Refund Policy. Nothing in these Terms limits any rights available to customers under the Australian Consumer Law.

 

11. Third-Party Services

Halalicious may use third-party services to provide certain Platform features, including:

• Location services;

• Mapping;

• Address searches;

• Payment processing;

• Notifications;

• Analytics;

• Hosting services.

These services may include providers such as Google, Mapbox, Stripe, PayPal, and other technology providers.

Third-party providers may change from time to time. Halalicious is not responsible for interruptions, errors, or failures caused by third-party services outside of our reasonable control. 

 

12. User Responsibilities

When using Halalicious, you agree that you will not:

• Provide false or misleading information;

• Create fraudulent orders;

• Abuse promotional offers;

• Attempt unauthorised access to the Platform;

• Interfere with Platform security;

• Upload unlawful, offensive, or harmful content;

• Submit false reviews or misleading complaints.

Halalicious reserves the right to suspend or terminate accounts involved in misuse or fraudulent activity.

 

13. Reviews and User Content

Users may submit reviews, ratings, comments, or other content. By submitting content, you confirm that:

• Your content is based on your genuine experience;

• Your content does not violate any laws or third-party rights;

• Your content is not defamatory, abusive, discriminatory, or misleading.

Halalicious may remove content that breaches these Terms.

 

14. Promotions and Offers

Restaurants and Halalicious may provide promotions, discounts, vouchers, or special offers. Unless otherwise stated:

• Offers are subject to availability;

• Offers may have expiry dates;

• Offers cannot always be combined;

• Restaurants may withdraw offers according to their promotional conditions. 

 

15. Intellectual Property

All intellectual property relating to Halalicious, including:

• Website content;

• Application software;

• Logos;

• Branding;

• Graphics;

• Images;

• Designs;

• Databases;

belongs to Halalicious or its licensors. You must not copy, reproduce, modify, distribute, or commercially exploit any Platform content without written permission.

 

16. Privacy

Your personal information is collected and handled according to the Halalicious Privacy Policy. By using the Platform, you consent to the collection and processing of your information as described in our Privacy Policy.

 

17. Limitation of Liability

To the maximum extent permitted by law, Halalicious is not responsible for:

• Food preparation by restaurants;

• Food quality;

• Restaurant conduct;

• Allergic reactions caused by restaurant products;

• Incorrect restaurant information;

• Restaurant delays or cancellations;

• Third-party service interruptions. Where liability cannot be excluded under Australian Consumer Law, Halalicious liability is limited to the remedies available under applicable legislation.

 

18. Account Suspension and Termination

Halalicious may suspend or terminate your account if you:

• Breach these Terms;

• Engage in fraudulent activity;

• Misuse the Platform;

• Harm other users, restaurants, or Halalicious.

Termination does not affect rights or obligations that existed before termination.

 

19. Changes to These Terms

Halalicious may update these Terms from time to time. Updated Terms will be published on the website or application. Your continued use of the Platform after changes are published means you accept the updated Terms.

 

20. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes relating to these Terms will be subject to the courts of Victoria, Australia.
